The adage “an ounce of prevention is worth a pound of cure” is no less true in the litigation arena. A proper and defensible litigation hold and preservation plan is the most critical part of discovery, and good litigators must know how to take charge of that process from the start in order to safeguard their clients’ interests throughout the lifespan of the litigation. Using hypotheticals, this program will explore some practical solutions to common document retention and production issues faced in civil and criminal investigations and litigation.
